Terms of Service

These Terms of Service (“Terms”) govern your use of Xpand Digitally's services and website. By engaging our services or using this site, you agree to these Terms.
1. Services Offered
Xpand Digitally provides: WordPress design & development, WordPress maintenance & support, web & app development, social media marketing, SaaS development, and virtual assistant services. The specific scope of any engagement will be defined in a separate written proposal, quote, or agreement between you and Xpand Digitally.
2. Proposals and Quotes
Any quote or proposal provided is valid for 14 days unless otherwise stated, and does not constitute a binding agreement until accepted in writing by both parties.
3. Payment Terms
Payment terms are confirmed in each project's proposal. As a general structure: for one-time projects, a 50% deposit is required before work begins, with the remaining 50% due upon completion and before final delivery of files or site access; larger projects may follow a milestone-based schedule instead. For recurring services (maintenance, marketing, or virtual assistant hours), payment is billed monthly in advance and renews automatically unless cancelled with 30 days' notice. Deposits are non-refundable once work has commenced. Work may be paused if payment is more than 14 days overdue.
4. Intellectual Property
Upon full and final payment, the client owns the final deliverables created specifically for their project (e.g., the completed website, custom code written for them). Xpand Digitally retains the right to display completed work in its portfolio and case studies unless otherwise agreed in writing. Any pre-existing tools, frameworks, or proprietary code libraries used to deliver the work remain the property of Xpand Digitally.
5. Client Responsibilities
Timely delivery of projects depends on the client providing necessary content, feedback, access credentials, and approvals in a reasonable timeframe. Delays caused by the client may extend project timelines accordingly.
6. Revisions
The number of included revision rounds will be specified in your project proposal. Additional revisions beyond that scope may be billed separately.
7. Warranties and Disclaimers
We strive to deliver high-quality work but do not guarantee specific business outcomes (e.g., search rankings, traffic, or sales) since these depend on many factors outside our control.
8. Limitation of Liability
To the maximum extent permitted by law, Xpand Digitally's total liability for any claim arising from our services is limited to the amount paid by the client for the specific service in question. We are not liable for indirect, incidental, or consequential damages.
9. Termination
Either party may terminate an ongoing engagement with written notice, as specified in the project agreement. The client remains responsible for payment for work completed up to the termination date.
10. Confidentiality
Both parties agree to keep confidential information shared during the course of the engagement private, and not disclose it to third parties without consent, except as required by law.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of Pakistan. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved, either party may pursue resolution through the courts of Islamabad, Pakistan, or, at either party's election, through binding arbitration conducted in accordance with the laws of Pakistan.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
